FYI, all the provinces exempt lawyers from registration under the various statutes that regulate real estate salespersons. I'd be pleased to send you a document that lists the various provincial provisions.

Vancouver realtors say lawyers using threats to extract part of agent's commission:

We were very disturbed by complaints we received recently from several Vancouver realtors asking for advice regarding lawyers who threaten to nix the deal unless they are given a percentage of the agent's commission. Here's our e-mail to the law society's ethics committee:

We've had a few complaints lately from realtors we trust regarding lawyers representing clients in a real estate transation who have threatened to nix the deal unless the realtor representing the other party agrees to provide a percentage of the commission. Transactions involving hard-to-sell properties are especially targeted, so we're told. The realtors would like to know how they should handle this type of confrontation, especially when they are likely to meet the same attorneys again in future transactions. All advice gratefully received.

You may wish to consult a lawyer through the British Columbia Branch of the Canadian Bar Association Lawyer Referral Service, where you can obtain 1/2 hour of advice for a fee of $25.
